CTA Divvy Bundle Co-Promotion Offer Terms and Conditions
During the promotional period, Divvy is offering qualified Chicago Transit Authority ("CTA") Ventra card holders $5 in Divvy credit (“Divvy Credits”) with the purchase of a CTA/Pace 30-Day Pass. Qualification requires a Ventra card, one time completion of an online program sign-up form, and consent to sharing account information in connection with this program.
Data or account information obtained by CTA, Lyft Bikes and Scooters LLC (“Lyft”), Chicago Department of Transportation (“CDOT”), Divvy and Ventra (“Party” or “Parties”) may be shared among the parties for operation or evaluation purposes only. Account information shall include, but not be limited to emails, addresses, and purchase and ridership history. From time to time, the CTA may additionally conduct online surveys that customers will be invited to complete on a voluntary basis. Data collected through such surveys may be shared among Parties.
Each Party shall implement adequate security measures to maintain the confidentiality of information and data transferred in connection with this Promotion. Any documents, data, records or other information given to or prepared by the Parties pursuant to this Agreement shall be maintained in a confidential manner (“Confidential Information”). The parties shall not sell, furnish, or otherwise make available any Confidential Information to other persons, firms, corporations, partnerships, members of the public or persons without prior written approval of the parties, except to the extent required by law.
Participation in this offer requires acknowledging the Ventra Terms and Conditions, Ventra Privacy Policy, and the Divvy Bicycle Rental Agreement. Redemption requires a registered Divvy account and a registered physical or virtual Ventra card. However, participation is subject to pay per ride Divvy users only; currently enrolled users in the Divvy Membership or Lyft Pink Membership are ineligible for participation in this offer. CTA/Pace 30-Day Passes may be purchased through the Ventra App, website, vending machines, retail network, customer call center, or service center. During the promotional period, only one promotional offer can be redeemed for each Ventra account for each CTA/Pace 30-Day Pass. Promotional offer does not provide additional benefits to Divvy users with memberships or to daily passes.
CTA reserves the right to terminate, cancel, modify, or suspend the offer at any time for any or no reason in CTA's sole discretion without prior notice or liability to you. This offer may not be combined with any other offers. This offer is non-refundable, non-transferrable, and may not be resold or redeemed for cash. Violation of these terms may lead to the offer being invalidated. This offer is void where prohibited. CTA is not responsible for errors or delays in the processing of any Divvy promotional offer. The promotional offer applies only to classic Divvy bike and scooter rides; overages, e-bikes, taxes, and out-of-hub fees will be charged separately.

CTA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CTA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CTA AND ITS EMPLOYEES, OFFICERS, DIRECTORS AND AGENTS WILL NOT BE LIABLE FOR DAMAGES OF ANY KIND ARISING FROM YOUR PARTICIPATION IN THIS PROMOTION OR YOUR USE OF THE MOBILE VENTRA CARD INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL CTA'S TOTAL LIABILITY TO YOU FOR ANY AND ALL DAMAGES, LOSSES, AND CAUSES OF ACTION IN CONNECTION WITH THE OFFER OR THE MOBILE VENTRA CARD EXCEED THE AMOUNT OF THE VALUE OF THE PROMOTION, WHICH IS $5.
This offer shall be governed and construed in accordance with the laws of the State of Illinois without regard to its choice of law provisions. Each party submits to the sole and exclusive jurisdiction of the appropriate state court of competent jurisdiction in Cook County, Illinois.
